Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Contractor Growth LLC ("we," "our," or "us"), you ("Client" or "you") agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services Provided

Contractor Growth LLC offers digital marketing and lead generation services for contracting businesses — including landscaping, roofing, concrete, remodeling, and other home services companies. Services include but are not limited to:

• Facebook & Google advertising
• AI-powered appointment booking
• Lead capture and CRM automation
• Retargeting & remarketing campaigns
• Website design and SEO
• Consulting and analytics

Specific service deliverables will be outlined in a signed service agreement or invoice.

3. Client Responsibilities

Clients are responsible for:

• Providing accurate business information and approvals in a timely manner
• Managing follow-up on leads delivered (if outside of our follow-up scope)
• Complying with local advertising laws and business regulations
• Ensuring appropriate licensing to operate their contracting business

Failure to provide necessary materials or approvals may delay results and is not grounds for a refund.

4. Fees & Payment Terms

Clients agree to pay all fees as outlined in the invoice or signed agreement. Payment terms:

• Setup fees are billed at the time of onboarding
• Monthly retainers are billed in advance
• Performance-based fees (e.g., pay-per-booked-appointment) are billed weekly or per occurrence
• Ad spend is billed separately and paid directly to the ad platform or to us, as specified in the agreement
• Late payments are subject to a 5% late fee per 10 days overdue

We reserve the right to pause or terminate service for non-payment.

5. Lead & Appointment Guarantees (If Applicable)

If a lead or appointment volume guarantee is offered in writing, it applies only if:

• The client actively follows up with leads
• The client does not reject qualified leads based on personal preferences
• The client has not paused, altered, or canceled the campaign during the period

Refunds or compensation will only be honored according to the signed agreement terms.

6. Refund Policy

Due to the nature of digital services and ad spend, all payments are final unless stated otherwise in writing. No refunds will be provided for partial months of service, unused portions, or dissatisfaction due to factors outside our control (e.g., market conditions, client response delays).

7. Data Collection & Privacy

We collect limited personal data (e.g., name, phone, email) to generate leads and deliver services. Clients and leads may request to access, delete, or opt out of data collection at any time. 8. Intellectual Property

All campaign assets, creatives, ad copy, workflows, and systems built by Contractor Growth LLC remain the intellectual property of Contractor Growth LLC unless explicitly transferred via contract. Clients may not reuse or redistribute materials without written permission.

9. Limitation of Liability

Contractor Growth LLC is not liable for:

• Loss of revenue from client-side issues (e.g., failure to close leads)
• Technical failures beyond our control (e.g., Facebook/Google outages)
• Indirect, incidental, or consequential damages arising from our services

Our total liability is limited to the amount paid by the client for the month of the issue.

10. Termination

Either party may terminate the agreement with 7 days' written notice. We reserve the right to terminate immediately for non-payment, abusive behavior, or violation of these terms.

11. Governing Law

These terms are governed by the laws of the State of California. Any disputes arising from this agreement shall be resolved in San Francisco County, California.

12. Changes to Terms

We may update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the new terms.
